I retain artist ownership rights over all commissioned artwork, and may freely use commissioned artwork to display as examples in my portfolio, post in online and social media galleries, advertise my business, record and distribute the process, files and different versions of said artwork unless agreed in writing.

You may request that your commissioned artwork remain private and unposted upon commissioning me, or deleted/removed from my websites and connected medias at any time after (both of these will require a fee equal to 100% the commission’s initial quoted price).

I will not use artwork commissioned from me by clients as branding, as social media identifiers like avatars and headers, to create merchandise or physical products, or to resell/redistribute in any way. I will not claim ownership over any subjects or characters depicted in the artwork.

Clients may freely use artwork they have commissioned from me for personal use, which includes but isn’t limited to: creation of digital or physical (ie. print) end products for personal enjoyment; creation and distribution of digital end products shared to non-commercial and non-monetized social and content platform accounts belonging to the Client; claim the character(s) as your own, but not the artwork itself.

Do not claim credit, ownership, or copyright over the artwork. Credit is required for all public uses.

Commercial use of commissioned artwork is not permitted without first directly discussing with me either beforehand or after commissioning me. I will require the purchase of a commercial licensing fee in all cases, the price of which may vary between artworks and clients, and may include the addition of artist’s royalties, depending on the intended commercial usage of the art.

Commercial use includes but isn’t limited to: creation, re-selling, and distribution of value-add or derivative digital or physical end products made with the artwork by the Licensee; creation and distribution of digital and physical content to promote the re-selling of value-add digital or physical end products created by the Licensee; creation and distribution of digital end products shared to commercial and monetized social and content platform accounts belonging to the Licensee.

Resale or transfer of commercial rights to the commissioned piece must be discussed with me by both parties involved in the transaction, in which case the commercial licensing fee and/or artist’s royalties must be renewed by the recipient.

Purchasing of commercial or licensing rights does not relieve a commissioner of providing proper credit for the artwork. All of the art pieces will have my signature in a visible place, and may not be removed by any means.

All commissioned artwork must be credited to me in some way that is visible near the artwork being used, such as the inclusion of my username ‘Ereru.’ Credit for personal use is appreciated as a username plug on social medias or artist’s credits on Toyhouse. Credit for commissioned artwork must include a username plug and a link back to my website, [ereru.carrd.co].

A credit line suitable to the design of the page or context will be used. Client agrees to pay an additional 50% of the total fee for failure to include the credit line. Credit line is required independent of Artist’s signature, which shall be included at Artist’s discretion unless otherwise agreed in writing.

If the client breaks any of the points stated above they will lose all the beforementioned rights to the artwork commissioned to me, Ereru (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit.

I retain artist ownership rights over all character designs created by me including “custom designs” and “adoptable designs”, and may freely use the artwork to display as examples in my portfolio, post in online and social media galleries, advertise my business, record and distribute the process, files and different versions of said artwork unless agreed in writing.

Full personal and commercial rights to a character design are included upon purchase of the design and the transfer of the character’s artwork files and/or Toyhouse profile to the recipient, whether it be the client or giftee. This includes both commissioned custom designs and pre-made adoptable designs. No additional commercial license fee will be requested as it is implied to be included in the initial agreed-upon price of the design.

Modify the design in any way you wish. The original artwork must not be altered in any way. This means that if you would like to alter the character further, it must be done in a completely new piece. Tracing/editing over my original artwork is not tolerated in any way and does not permit future commercial use of the edited artwork.

Sell, trade, or gift any of my designs at your own discretion. Personal and commercial rights to the character are included upon transfer unless otherwise agreed upon. I will not settle ownership disputes.

Obtain a design of mine with the intention of resale with the creation and inclusion of original, additional artwork. This includes pre-made fursuits, plushies, etc. If you have questions about this in particular, feel free to reach out and discuss!

You only may re-sell the design “as-is” for the original purchase price, excluding any sales tax and tips, if it doesn't include additional value-add activities or derivative digital or physical end products. (additional created or paid commissioned art or physical products).

Use my original artwork of the design commercially or for profit. If you would like to use my artwork of the character design commercially, you may commission me for new artwork which will include a commercial license fee and/or artist’s royalties.

Owners of my designs may NOT create a “species,” including open / nonprofit or closed / for-profit, based on that character design or its unique traits, without explicit permission from myself. If a design is originally a member of an open or closed species, you may not claim the species as your own. You must follow the rules for that species regarding the design and usage of the character.

All character designs created by me must be credited as a username plug and/or link and must remain visible and/or accessible. Credit can be featured in posts of my art of the design to your social media or art galleries, or within a character's profile or gallery. No need to credit me for the design in posts of your or another artist's art.

For custom designs I refuse to work on more than 3 revisions after the artwork is completed. Further changes will require an upfront payment.

For Open / Closed Species, it's full responsibility for the customer to follow the species rules, guidelines, item effects, restrictions, etc. before asking the artist to do the artwork required.

When the character is approved and delivered to the client, I'm by no means responsible for any further changes these may need / the client wants to add without asking it as a commission or a fee is discused. I'm by no means responsible of the design once it is out of my hands.

If the design is not wanted for the client anymore after it has been fully delivered, refunds are not possible.

Any violation of the terms and conditions for my designs can result in me cancelling the custom creation and use the design in any way I see fit.

By purchasing and/or downloading digital content from me, you are stating that you have read over and agreed to these outlined permissions.

Works created by me must be explicitly stated by me as being “bases”, “base linearts”, or otherwise purchaseable / downloadable digital content for these permissions to apply. I only sell / post digital resources on my Ko-fi Shop.

All rights not expressly granted are retained by the Artist, including any electronic rights or usage unless specified and including, but not limited to, all rights in sketches, compositions, or other preliminary materials.

All usage rights are conditioned upon receipt of full payment and proof of purchase. Upon receipt of full payment, Artist shall deliver digital files necessary to enable Client’s usage rights granted herein. Any use additional to that expressly granted requires arrangement for payment of a separate fee.

Refunds for digital purchases are not available. In case a purchase is cancelled for any reason,usage rights granted herein will be revoked. Client will return all work products, and permanently delete all digital files, within 30 days after expiration of client’s usage rights hereunder.

All digital resources must be credited to me by the inclusion of my username ‘Ereru’ if in any way used for profit, or otherwise shared or posted online. For lineart bases, please do not link my account in the artist credits on Toyhouse - simply putting my username in the image description is enough.

All works with commercial intentions include a Licensing Agreement document that acknowledges the usage, validity and protects both the Licensor (Ereru) and the Licensee (Purchaser) in writing

Lineart bases may be used for both personal use and profit, unless they are available for free, including creating character designs both for personal use and as adoptable designs for sale, custom design commissions, and “YCHs” / “your character here”s.

Purchasers of my digital resources may edit them in any way and as much as you like, as long as the artwork remains free of hateful material: edit bodytype, species, expressions, fur; add clothing, objects, etc.

Reselling or otherwise redistributing any source files of my work is strictly prohibited, including if they are edited, traced, or otherwise transformed.

Claiming whole credit, artist ownership, or copyright over my digital resources or artwork made using them is prohibited. Character designs made on my bases are the only exception, barring the artwork made using my work.

Commercial use of any and all digital resources created and distributed by me is prohibited. This includes but is not limited to use as branding and advertising, and printing as merchandise or for resale.

Downloadable resources outside of lineart bases may not be used for profit in any way.

All usage rights are conditioned upon receipt of full payment and permanence in the membership program. Upon receipt of full payment, Artist shall deliver digital files necessary to enable client’s usage rights granted herein. Any use additional to that expressly granted requires arrangement for payment of a separate fee.

The Artist retains ownership of all original work products, in any media, including digital files, whether preliminary or final. Client will return all work products, and permanently delete all digital files, within 30 days after expiration of client usage rights hereunder.

The Artist retains ownership of all original artwork/resources/media, whether preliminary or final, and the clietn shall stop the usage of such artwork, and all copies thereof, and shall permanently delete all digital copies thereof, within 30 days of the ex-piration of client’s usage rights.

This Commission Contract's ("contract") purpose is to outline binding terms between Ereru ("Artist", "me/my," "I"), and users of my Services ("you," "client") that purchase custom illustration commissions ("commission," "art," "artwork") from me.

By entering into a commission contract with me, you state that: 1) you agree to my Art Terms of Service, 2) that this contract is legally binding, 3) that you are an adult 18 years or older, and 4) that you understand this contract applies per each piece of commissioned artwork, and does not establish an exclusive work relationship.

Commissions include specific permissions of usage. You can find these outlined in my Art Terms of Service!

I reserve the right to update this contract at my discretion. Changes to this contract will be effective immediately upon posting the updated terms, and will apply to all commission contracts going forward.

I reserve the right to refuse to enter a contract and to cancel active contracts at any time.

Any grant of rights is conditional upon receipt of full payment. Upon receipt of full payment, Artist shall deliver digital files necessary to enable Client’s usage rights granted. Any use additional to that expressly granted requires arrangement for payment of a separate fee. Artist retains the rights to display all work created by Artist for this Project, including preliminary materials and final art, in Artist’s portfolios, including in print and online.

Payment must be provided upfront and completed in full before I begin working on your commission. Payment plans may be discussed per client, in which I will require a downpayment of at least 50% of the total price and may not exceed a month-long (four week) timeframe.

If payment is not received within: ten days of invoicing for single-payment contracts, or by the agreed-upon deadline for payment plans, then the commission contract will be canceled and your slot revoked.

Private commissions, major edits in later stages of the commission process, and deadline requests will each enact an upcharge of 50-100% the quoted price. If there's an extremely short deadline the fee can go higher

Don't send me any kind of payment before I contact you confirming your commission has been accepted! If you do this, I will take it as a donation and refund will not be possible.

A clear visual reference of the subject(s) is required for illustration work - written descriptions and "patchwork" refs are accepted for design work only.

You can check up the status of your piece anytime through my Trello page or the link I will give you (This link is your personal ticket on my queue)

Turn around time depends on complexity, waiting list and any other unforeseen circumstances. Minimum can be 1 week - 3 months AFTER starting to work on the commission (reaching your spot on my queue), not after payment, to assure maximum quality.

If you're not willing to wait (check my trello for my art queue) By all means don't commission me!

"Redlining" or drawing over a work-in-progress by the client is acceptable to show specific edits, however please keep in mind that you are commissioning me for my art style. I do not accept requests to emulate particular art styles for commission work.

Finished piece will be sent to you as an HD image file through mail or download link. I don't send any original editable files (clip, psd, after effects, live2d or any original files) unless asked to.

A Commission Contract is completed upon the approval of the finished commissioned artwork by the client, and the transfer of all pertinent artwork files.

Client has 3 free revisions for small changes (small tweaks) before the commission reaches coloring stage. If any changes are requested by the client after the piece has started coloring stage or finished and delivered, these are extra and must be paid.

After the first sketch has been sent for revision, there's a time limit of two weeks during each commision stage to make revisions or give any kind of feedback before continuing to the next stage of the commision process. There won't be any room for further changes or complains if the commision is in its final stage, and the client didn't meet the 2 week time limit to make any revision in any other stage of the process.

Not started: client will receive a complete refund

Sketch: client will receive a refund of 70% the total price

Lineart/Color/Render: no refund will be issued
